These terms and conditions (the "Terms and Conditions") govern the use of www.thornvalleystudios.co.uk (the "Site"). This Site is owned and operated by Thorn Valley Studios.

This Site is an e-commerce platform offering photographic prints, workshops, and specialised booking services. By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

1. Intellectual Property

All content published and made available on our Site is the property of Thorn Valley Studios and the Site's creators. This includes, but is not limited to: images, text, logos, documents, downloadable files, and anything that contributes to the composition of our Site.

2. Acceptable Use

As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

  • Harass or mistreat other users of our Site;

  • Violate the rights of other users of our Site;

  • Violate the intellectual property rights of the Site owners or any third party;

  • Hack into the account of another user of the Site;

  • Act in any way that could be considered fraudulent; or

  • Post any material that may be deemed inappropriate, offensive, or defamatory.

If we reasonably believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend, or terminate your access to our Site, alongside taking necessary legal steps.

3. User Contributions

Users may post public comments and reviews on our Site. By posting publicly, you grant Thorn Valley Studios a non-exclusive, royalty-free, perpetual license to display this content across our platform and certify that your contributions do not violate third-party intellectual property rights.

4. Accounts

When you create an account on our Site, you agree to the following:

  • You are solely responsible for your account and the security and privacy of your login credentials.

  • All personal information you provide to us through your account is up to date, accurate, and truthful, and you will update it immediately if it changes.

We reserve the right to suspend or terminate your account if it is utilized for unauthorized or illegal actions.

5. Sale of Goods and Services

These Terms and Conditions govern the sale of goods and services available on our Site.

Goods Available:

  • Photographic Print Products.

Statutory Duty: Under the Consumer Rights Act 2015, we are under a legal duty to supply goods that are of satisfactory quality, fit for purpose, and as described.

Services Available:

  • Outdoor Photography Workshops

  • Portrait, Product, Landscape Commissions, Event, and Digital Restoration Photography

  • Wedding Photography (Subject to a standalone, separate Wedding Contract)

Services must be paid for in accordance with the milestones selected at checkout. While we make every effort to display product variations accurately, subtle colour variations may occur depending on your digital display equipment. If an item is listed with an inadvertent material pricing error, we reserve the right to reject or cancel the order prior to dispatch and issue a full refund.

6. Payments

We accept the following payment methods on our Site:

  • Credit/Debit Card

  • Google Pay / Apple Pay

  • PayPal / Direct Debit

  • Klarna / Clearpay (Subject to separate credit check agreements provided by those respective vendors)

By providing payment information, you authorise us to charge the due amounts to your selected instrument. If your payment triggers automated fraud prevention alerts, we reserve the right to cancel or reverse your transaction for security purposes.

7. Shipping, Delivery, and Import Duties

We provide shipping through the following channels:

  • UK Standard Delivery (5–7 business days)

  • Royal Mail International Tracked & Signed

  • Overnight Courier

Delivery times are estimates and do not include weekends or UK public holidays. Standard UK delivery on listed retail items is provided free of charge unless premium courier options are expressly selected at checkout.

 

International Orders: If you purchase goods from us for delivery outside the United Kingdom, your shipment may be subject to import duties, customs clearings, and local taxes applied by the destination country. You are the importer of record and are solely responsible for paying any such duties or taxes. ---

8. Statutory Right to Cancel (14-Day Cooling-Off Period)

If you are a consumer residing in the United Kingdom or the European Union, you have a statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel your purchase within 14 days without giving any reason.

 

The cancellation window opens:

  • For Services: 14 days from the date the contract was entered into (purchase date).

  • For Goods: 14 days from the day you (or a third party nominated by you) physically receive the goods.

Exceptions to the Right to Cancel:

The statutory right to cancel does not apply to:

  • Custom or explicitly personalised goods (e.g., bespoke photo prints made to custom dimensional dimensions or custom commissioned prints).

  • Services that have been completely performed during the 14-day window at your explicit request.

  • Digital content downloads once the download or streaming process has actively commenced.

How to Exercise Your Right to Cancel:

To meet the cancellation deadline, you must send your clear statement to us before the 14 days expire. You can contact us via email at contact@thornvalleystudios.co.uk, write to us at our registered physical address below, or submit the Cancellation Form appended to the bottom of these Terms.

9. Effects of Cancellation, Returns, and Refunds

If you exercise your statutory right to cancel a physical product order:

  • You must return the goods to us without undue delay and no later than 14 days from the day you communicate your cancellation.

  • You must cover the direct cost of returning the goods. * We will refund all payments received from you, including standard delivery costs, within 14 days of receiving the returned goods back or receiving verified proof of return postage.

  • We may make a reduction from the reimbursement if the value of the goods has been diminished due to unnecessary handling by you beyond what was required to establish their nature and characteristics.

  • If you requested a service to begin during the cancellation period (e.g., a booked workshop scheduled within that time frame), you must pay an amount proportionate to the services delivered up until your cancellation notice.

10. Limitation of Liability

Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud, fraudulent misrepresentation, or for any breach of your core consumer rights under the Consumer Rights Act 2015.

Subject to the paragraph above, Thorn Valley Studios will not be liable for indirect economic losses, loss of business goodwill, or unexpected damages arising out of your use of the Site or booking platforms.

11. Applicable Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.

If a dispute arises, we encourage you to contact us directly to seek an informal resolution. If an amicable settlement cannot be reached:

  • Consumers living in Scotland or Northern Ireland may additionally bring claims within their respective local national court jurisdictions.

  • Alternative Dispute Resolution (ADR) or mediation services may be utilised by mutual consent prior to resorting to formal court proceedings.

12. Sever-ability and Changes

If any provision within these Terms is deemed invalid or unenforceable under applicable UK law, that specific provision will be severed, and the remaining provisions will continue in full force and effect. We update these Terms occasionally to reflect local compliance changes. Continued use of the platform following an update constitutes acceptance of the revised Terms.
